These Terms of Use (“Terms”) apply to your use of the websites, mobile applications, and other resources provided by Arkangel AI, a U.S. company, and its affiliates (referred to collectively as “Arkangel AI,” “us,” “we,” and “our”). These resources are intended for use by healthcare professionals and are collectively referred to as the “Arkangel AI Platform.”
By using the Services, you agree to these Terms, whether or not you are a registered member of the Arkangel AI Platform. These Terms govern your use of the Services and create a binding legal agreement enforceable against you in case of a violation.
If you do not agree to all of these Terms, do not use the Services!
You must register an account with Arkangel AI to access all of the Services. Registration requires certain information such as your name, email address, profession, specialty, and any other details requested in the registration form, as well as a username and password. You agree that your registration information will remain true, accurate, current, and complete, and that you will update it promptly as needed. We may verify the accuracy of that information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity under your account. If you believe your account has been compromised, immediately change your username and password or contact us for assistance. We disclaim liability for unauthorized access to your account.
Arkangel AI is an experimental technology demonstrator and does not provide medical advice, diagnosis, or treatment. User questions and other inputs on Arkangel AI are not covered by HIPAA. It is your responsibility to ensure questions do not contain protected health information (PHI) or any information that violates another person’s privacy. The Services are intended for physicians and other healthcare professionals. By using the Services, you confirm that you have the right, authority, and capacity to agree to and comply with these Terms.
The information and tools available through the Services are for educational and informational purposes only. They are not intended to serve as a diagnostic service or substitute for the clinical judgment of a qualified healthcare professional. You agree not to use the Services to create a physician-patient relationship or to diagnose or treat users. You are solely responsible for evaluating information from the Services and complying with applicable laws and professional standards.
You may also be subject to additional obligations in the jurisdiction where you practice. We make no representation regarding the legal compliance of the Services, and you are solely responsible for complying with the laws of your jurisdiction concerning your use of the Services and Arkangel AI Content. We reserve the right, at our discretion, to limit the availability and accessibility of the Arkangel AI Platform, Services, and content based on geography or jurisdiction.
Note to consumers: If you are a consumer accessing professional-level information through the Services, do not rely on it as professional medical advice. For medical concerns, including treatment and medication decisions, always consult a qualified healthcare professional.
Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, and non-sublicensable license to use the Services and to view the information and materials provided, including User Content (“Arkangel AI Content”), for personal and professional use only. You may not copy, adapt, modify, prepare derivative works of, distribute, license, sell, transfer, publicly display, perform, transmit, stream, broadcast, or otherwise exploit the Services, Arkangel AI Content, or Arkangel AI properties except as expressly permitted by these Terms. All rights not expressly granted are reserved by Arkangel AI and its licensors.
The Arkangel AI Platform may contain links to third-party websites or resources. We are not responsible for the availability or content of those websites and resources and do not endorse them.
You agree not to engage in any of the following activities in connection with your use of the Services:
Certain Services allow users to submit content, including text, images, data, and other information (“User Content”). User Content does not include registration information. When you submit User Content, you automatically grant Arkangel AI a perpetual, non-exclusive, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to use, distribute, transmit, host, display, and perform that User Content in any format now known or later developed. You agree to comply with all laws related to privacy and to follow sound clinical and ethical practices.
Arkangel AI and its licensors retain all rights in the Arkangel AI Platform, software, and content. You agree not to modify, copy, distribute, rent, lease, loan, sell, transmit, broadcast, or otherwise exploit any part of Arkangel AI Content or software except as permitted under these Terms.
Arkangel AI may collect, use, transfer, sell, and disclose non-personal information and customer usage data for commercial purposes. Licensed third parties may access Arkangel AI user data as permitted under relevant agreements, but they may not use that data for unauthorized purposes.
Arkangel AI does not provide medical advice and should not be used for diagnosis or treatment. Consult a qualified healthcare professional for any medical concerns.
The Arkangel AI Privacy Policy, incorporated into these Terms, explains how we collect, use, and disclose information.
These Terms are governed by the laws of Delaware, U.S.A., without regard to its conflict-of-law provisions. Arkangel AI may terminate your account or your access to the Services for any breach of these Terms, for legal requirements, or for prolonged inactivity.
ARKANGEL AI AND ITS LICENSORS OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR SPECIAL DAMAGES ARISING OUT OF YOUR USE OF THE SERVICES.
You agree to indemnify and hold Arkangel AI harmless from claims arising out of your use of the Services or your violation of these Terms.
These Terms, together with the Privacy Policy, constitute the entire agreement regarding your use of the Arkangel AI Platform. Arkangel AI reserves the right to modify these Terms, and your continued use of the Services constitutes acceptance of any updated Terms.
